1Password Gift Card Terms and Conditions (U.S.)

These Gift Card Terms and Conditions (“Gift Card Terms”) govern the purchase, use, and redemption (collectively, “Use”) of 1Password Gift Cards (“Gift Cards”) issued and sold in the United States by AgileBits Inc. dba 1Password, an Ontario, Canada corporation (“1Password,” “we,” “our,” or “us”).
By purchasing, accepting, or using a Gift Card, you agree to be bound by these Gift Card Terms and the 1Password Terms of Service and Privacy Policy, which are incorporated by reference. If you do not agree to these Gift Card Terms, do not Use a Gift Card.
To the extent that there are conflicts between these Gift Card Terms and the broader 1Password Terms of Service, these Gift Card Terms will govern with respect to the Use of Gift Cards. You agree and acknowledge that 1Password may process your personal information in connection with your Use of Gift Cards in accordance with our Privacy Policy.
In these Gift Card Terms, “you” and “your” specifically means the cardholder who Uses a Gift Card.
1. About 1Password Gift Cards.
Gift Cards are digital gift codes sold exclusively at https://1password.com/giftcards/ for use on 1Password.com (United States region only). Gift Cards have no value until activated, and 1Password may suspend or delay activation until payment clears.
Gift Cards can only be redeemed towards the purchase of eligible 1Password subscription services available through 1Password.com (the “Services”). Gift Cards are not debit or credit cards and have no implied warranties. Gift Cards are not reloadable. Gift Cards may not be redeemed on 1Password accounts billed outside the U.S. region. Gift Cards are issued in U.S. dollars only.
2. Redemption of Gift Cards.
To redeem a Gift Card, you must have or create a 1Password account at https://1password.com/ and be the age of majority in your jurisdiction of residence. Upon redemption, the full value of the Gift Card will be applied as a credit to your account balance and automatically applied toward the next billing charge. This credit will also appear under the Billing section of your 1Password account.
Your Gift Card balance will remain available until it reaches zero. You must have sufficient funds on the Gift Card to cover subscription charges or, if the Gift Card balance is insufficient, pay the difference using an accepted payment method. Should you wish to continue using the Services after your Gift Card is exhausted, you are solely responsible for paying all applicable fees. Multiple Gift Cards may be redeemed to the same 1Password account, subject to verification.
3. Limitations on Use of Gift Cards.
Gift Cards may not be: (i) purchased through unauthorized resellers or auction sites; (ii) used on non-U.S. 1Password sites; (iii) reproduced, duplicated, copied, reloaded, resold, or transferred for value; (iv) used to purchase other gift cards or prepaid products; or (v) used for unauthorized marketing, promotional, or commercial purposes. 1Password may impose limits on the number or value of Gift Cards purchased per person, per transaction, or per day, and may require additional identity verification for high-value or suspicious purchases.
4. Fees and Expiration.
Funds on 1Password Gift Cards do not expire and are not subject to any activation, service, dormancy, or maintenance fees. Gift Cards do not earn interest.
5. Refunds.
1Password Gift Cards are not redeemable for cash and cannot be returned or exchanged, except where required by law. Unused Gift Card balances are non-refundable. Certain states require cash redemption of gift cards with low balances. Where required by law, you may request cash redemption of the remaining balance if it falls below the statutory threshold.
6. Subscription Cancellations.
You can cancel a subscription purchased using a 1Password Gift Card at any time; however, no refund will be given for the unused portion of your subscription.
7. Risk of Loss.
The risk of loss and title for Gift Cards pass to the purchaser upon our electronic transmission of the Gift Card to the purchaser or designated recipient. Cardholders are responsible for safeguarding Gift Cards from unauthorized use. 1Password is not responsible if a Gift Card is lost, stolen, or destroyed, or used without your permission. Gift card scams are common and 1Password does not assume liability for any fraudulent activity by third parties. 1Password is not obligated to replace or reissue a lost or stolen card, even with proof of purchase. If a payment used to purchase a Gift Card is charged back, reversed, or declined, 1Password may cancel the Gift Card or deduct the corresponding amount of credit from the associated 1Password account.
8. Balance Inquiry and Support.
Once redeemed, users can view their remaining Gift Card balance in their 1Password account’s Billing section. For unredeemed Gift Cards or inquiries regarding redemption, activation, or account balances, please contact [email protected]. 1Password reserves the right to require additional verification of your identity and ownership of the Gift Card or account before responding to certain inquiries.
9. Violation of these Gift Card Terms; Suspension; Fraud and Misuse.
By Using a Gift Card, you agree to comply with these Gift Card Terms, and to not use a Gift Card in any manner that is illegal, unauthorized, misleading, deceptive, unfair, or otherwise harmful to 1Password. 1Password reserves the right, without notice to you, to refuse to honor, deactivate, or void Gift Cards without a refund; suspend or terminate your 1Password account if we suspect that a Gift Card is obtained, used, or applied to a 1Password account fraudulently, unlawfully, or otherwise in violation of these Gift Card Terms.
10. Compliance with Laws; Indemnification.
The purchase and use of Gift Cards are subject to all applicable U.S. federal and state laws, including the Credit Card Accountability Responsibility and Disclosure Act of 2009 (CARD Act). Your Use of a Gift Card certifies and represents to 1Password that the activities in which the Gift Card will be Used will comply with all applicable laws. You agree to defend and indemnify 1Password and its affiliates, officers, directors, agents, and employees, from and against any claims, expenses, or liabilities arising from your fraud, unlawful conduct, or material violation of these Gift Card Terms. Balances on Gift Cards may be subject to unclaimed property laws. Where required, 1Password may remit remaining balances to the appropriate state authority.
11. No Promotional Use or Affiliation with 1Password.
Gift Cards may be used as personal or business gifts but may not be used in connection with any marketing, advertising, or other promotional activities. You may not use 1Password’s name, logo, trade dress, or other intellectual property – including any image or likeness of the Gift Cards – in any manner that suggests endorsement, sponsorship, or affiliation with 1Password.
12. Disclaimers and Limitation of Liability.
GIFT CARDS ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN THE EVENT A GIFT CARD IS NON-FUNCTIONAL, THE CARDHOLDER’S SOLE REMEDY AND 1PASSWORD’S SOLE LIABILITY WILL BE THE REPLACEMENT OF THAT GIFT CARD. TO THE MAXIMUM EXTENT PERMITTED BY LAW, 1PASSWORD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES RELATED TO OR ARISING FROM THE USE OF A GIFT CARD. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU.
13. Governing Law; Disputes.
These Gift Card Terms and any disputes relating to Gift Cards are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. This choice of law does not limit any rights you may have under mandatory consumer protection laws in your state of residence. Any disputes will be resolved exclusively in accordance with, and subject to, the dispute-resolution procedures set forth in the 1Password Terms of Service.
14. Severability.
If any provision of these Gift Card Terms is deemed unlawful, void or unenforceable, such provision shall nonetheless be modified or restricted to the extent, and in the manner necessary, to render it valid, legal, and enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Gift Card Terms. If such provision cannot be so modified or restricted, it shall be excised from these Gift Card Terms without affecting the validity, legality, or enforceability of any other remaining provisions of these Gift Card Terms, which shall be fully enforced.
15. Waiver.
The failure of us to exercise or enforce any right or provision of these Gift Card Terms shall not constitute a waiver of such right or provision. Any ambiguities in the interpretation of these Gift Card Terms shall not be construed against the drafting party.
16. Changes to Gift Card Terms.
1Password reserves the right to modify these Gift Card Terms at any time, consistent with applicable laws. The most current version will always be available at https://1password.com/giftcards/.
